I have to do a emergency travel to India and I did not get my advance during that time. I went to USCIS office in person and got the advance parole and flyed to India.
Back in US I learnt from my wife that I got another copy of Advance parole which I have applied earlier. Both Parole documents look different in format and the one which I got from USCIS office does not have the SRC nubmer on it.
If my wife sends the recent Advance Parole documents via FEDEX, not sure which document I should show up at port of entry..Plese help.

If your processing date is current, if your PD is current, and if you are name check is cleared, they most likely be processing or processed your case.
If your processing date is current, if your PD is current, but if you are name check is not cleared, and so as per new rule, they will process your case in a month or so.
If your processing date is current, but if your PD is not current, but if you are name check is cleared, most probably they will pre-adjudicate your case. So the day your PD becomes current, you will get your GC. In this case if your NC is not cleared, you have to wait another month as long as you are above 180days of NC waiting...
If your processing date is not current, but if your PD is current, I have seen people getting GC, so I believe they must have cleared their NC. But I don't quite understand this scenario...

1)My I 94 expires in 2 months.I don't want to extend H1 and I want to use EAD.So how can I extend my I94 if I start using EAD?
2)I finished 4yrs of stay on H1B. If I don't extend H1B now and start using EAD, if by any reason my 485 denies in future, can I switch back to my H1B and work for the remaining 2yrs on H1B?
Just start using your EAD and if you have an Advance Parole use that next time you enter the country from a trip abroad and you will get a new I-94.

TSC immigration officers answering phones at TSC are giving different status messages for the same candidate. The most commonly used answers are:
(1) Your finger print's are not uploaded to the TSC system.
Which is incorrect as the applicants went to their Infopass appointment and came to know there finger prints are done and after the applicants called FBI to confirm that the finger print results have been sent back to USCIS
(2) Name check not completed
(3) Visa number will not be allocated till october
The worst part is when you call the IO's after 10 minutes they give a different answer. The answers vary depend on the day and time of the call.
This has been goign on as per discussions in immigration forum @ http://boards.immigration.com/forumdisplay.php?f=98
Is there anyhting we can do about this IO's who are giving wrong information. Can we file any complaints?

My H-1 extension got approved recently . My visa has expired on the passport and I need to get a new stamp. The dates in all Indian consulates are full.

Though I am not an attorney, I would recommend removing the word "revoke" from the letter. Some less knowledgeable IO can read "revoke" along with "I-485" and do something disastrous.

Get a copy of your I-140 approval notice. You should be ok. If you apply for a new job, you can apply for 3 years extensions as well as your priority date is portable.
If you are anxious, just pay $1000 and get premimum processing of H1 in the current job.

I am applying for my AP and EAD renewal, please help me with few questions:
For EAD:
14) Manner of last entry: H4? (I was on H4 when I last entered)
15) Current Immigration Status: AOS? (My husband received his GC)
16) Eligibility: ???

1.3) Class of Admission: H4?

Last time, my husband's company attorney had filed our papers. Since, my husband received his GC, we have to renew ourselves. Should I send a form to cancel G28? Thanks in advance to all for their time and advise.

My PD is 11/2003 and my case was transfered to PA backlog center, I have not heard anything since then.
My employer wants to call the Senators and Congressmen to see if they can expedite this process.
Could you please provide some suggestions on:
1. What should the employer tell to the law makers?
2.How will the law makers help me?
3. Do you have any fax/email templates?
4. Any other suggestions?

Hi,
I was among those randomly selected for further processing in the Diversity Immigrant Visa (DV) program for the fiscal year 2010. Since I currently reside in the U.S., I filed Form I-485 ("Application to Register Permanent Residence or Adjust Status"). Upon having my biometrics taken, I had an interview with an Immigration Service Officer at a U.S. Citizenship and Immigration Services (USCIS) office. Because of a misunderstanding, I failed to bring to this interview an original Form I-134 ("Affidavit of Support") from a sponsor. Please note that my parents and sibling recently became U.S. citizens and are willing and able to be sponsors.
At the end of the interview, I asked the Immigration Service Officer if I can provide Form I-134 after the fact and he answered no. He made it sound as though a person gets only one chance at an interview with an Immigration Service Officer. He gave me a sheet of paper that had the following ticked off:
"Your case is being held for file review to prepare a decision. You will be advised by mail as to a decision on your application. No additional information is necessary from you at this time, however, if upon further review, additional information or evidence is required, you will receive notice in the mail. Please respond to any request in a timely manner. Failure to do so will result in denial of your application Please allow 60 days from today's date before making an inquiry on your case."
Questions:
1. Is there a way I can provide Form I-134 after the fact? If so, how?
2. If my application is denied, can I appeal the decision? If so, what are the chances of winning such an appeal and still finish adjusting my status before the DV program for fiscal year 2010 ends?

i am not sure... but as far as i know it is better to be in the country when the H4 extention is pending with USCIS
