    We had a 8 hr long meeting with a lobbying firm right on the Capitol hill. The meeting progressed very well. We came out with a wealth of information. This firm seems to have the right contacts and connections. I am creating a pointwise document the people in this firm promised and were confident to achieve. Just to let you know we have Labor Backlog centers and Retrogression on our agenda.
    We have appointment with another firm today will update everyone on monday.

    My current company's CEO is retiring and the other partners are forming a new company. The current company will continue as a corporation and in the new corporation the current CEO will have 10% share. The new co will start with the current client base, employees, equipment, web site and use the current company's name as a DBA.

    I am on H1-B visa with the current company and in the process for Permanent Residency with my I-140 approved and awaiting for the Priority Date to become current .

    If the current company terminated me and i got re-hired with the new co.. what would i need to do for my H1-B visa and the Green card process. Please advice ASAP.

    If its a new company, you need to do H1B transfer and start the GC from PERM. If the I-140 is not revoked, you can retain the PD.

    Hi gurus,

    I have question to you. I am July 2007 filer. My EAD and My wife EAD expiring on 09-25-2008. I applied both renewal Yesterday(06-24-2008 -90 days before).
    recently My wife moved from H1B and working on EAD ( I am still working on H1B).

    1. If we wont get EAD cards in time (i.e. before 09-25-2008). What will be her status after 09-25-2008 ?

    2. Can she change back to H4 or can she change back to H1?

    Please advice me.

    Don't worry about your status after EAD expires. As long as you have pending I-485 you are in status. Its a different matter that she might have to stop working until EAD is approved. That said, USCIS is super-fast in approving EAD and actually people have been complaining about it:D

    Besides, depending upon how the "CLASS" is defined- you will not lose your claim if they win the lawsuit.

    It does not require you to have filed your case to benefit from the class action , but it depends on how the class has been defined. You can goto Rajiv's website and hear the latest conference call recording which explains his opinion on this.

    It looks like the rumors are no more circulating of people being deported.

    There are no posts on the forum about it. So either there are no deportations now or people have realized that they were only rumors.

    On Feb 16, I invited my neighbours on daughter's b'day and one of the lady was saying that one of her friend's was given only 20 days I-94 due to this new memo after so many argument because she has to wind up all her belonging here including her brand new car and her friend is leaving tommorrow that was on Feb. 17 ..I advised her to contact IV ..but was short of time ..don't know what happened later..never asked..

    I personally knows a person who got deported and each and every incidents what happened to him. That happened in Jan-10 but not sure if same thing still continue or not. Because I knows only one incident

    Hi all,

    I am getting a new job offer and i applied my GC this July just like most of us here. Is it possible to accept the offer and transfer the H1B visa, then try and negotiate to start later as soon as 180 days are completed?

    What happens if i transfer my H1 now ... less than 180 days..and do not start with the new company, will my 485 still be processed? Lets say the H1 is transferred, but i plan not to use that H1 and stick to the same company where my H1 is, will that still be ok?

    I am confused, its a good offer, and i dont know what to do. pls help..

    Last week i received the letter about my RFE for my I140 which they received on Feb 8, 2007. I'm a EB3 category from Bangladesh.

    USCIS requested for the tax information of the company
    My W2 for last year and
    My Pay Stub....


    Is there anything else extra i have the provide. do i have to worry about anything towards my approval or this is just a regular process to go through.

    Maybe USCIS would earn more income by telling the illegal immigrants to file EAD/I-485/Biometics every year etc.. Immigration attroneys would earn good money by replying to RFEs for 12 million immigrants. Getting this 12 million illegal immigrants legalized will surely improve the economy.
    Everybody would be kept in the same backlog as we are. Illegal immigrants will stand in a que behind the legal immigrants. so you got the point

    I always carry a letter from Employer and I was asked once at Chicago. The letter says I am employed from this day, my job title, salary, visa status and they expect me to return to the employment after the trip. Hope this helps.

    I would appreciate a response to my immigration questions as discussed below from anyone knowledgeable on the nuances.

    I immigrated here at the age of 5 (in 1988) with my parents. We overstayed our visitor visas.

    In 2004, I married my high-school sweetheart, he petitioned for me and in 11/2005 we interviewed and I obtained my conditional permanent residence.

    In 9/2007, we signed the documents to convert my conditional to legal permanent residence. I became a legal permanent resident in 8/2008.

    After the signing by both parties but prior to receiving permanent residence, in 10/2007, he filed for divorce claiming constructive abandonment for 10 months. This was not what happened, and I was legally unwise, so I did nothing and signed the papers. I consulted my immigration counsel (in 8/2008 after receiving legal permanent residency) and the paralegal gave me the roundabout about having to see the divorce papers and he said that I may be penalized for the divorce at the time I apply for citizenship because of the 10-month constructive abandonment provision.

    I consulted with another immigration lawyer who said this would not be a problem at all.

    I have left the situation alone until now. I am looking to leave the my current immigration counsel due to their incompetence.

    1. When can I become a citizen (do I have to wait 5 years from 11/2005 due to the divorce)?
    2. What are the foreseeable problems when I apply for citizenship?
    3. Do I have to take any other steps?

    I look forward to any responses on this and appreciate the help in advance.

    Hi, I am on L1B since Dec'10. My visa is expiring in Apr'11. Due to project requirement, my company has plan for my visa extension. Is there any way to get the GC? If part-time study can help to process my GC faster, I am ready for that too.

    Today, my friend told me that there is new policy prohibiting employees from paying the H1B application fees for their employers. Has someone heard about this policy? If so, would you please provide me some more details on the issue? Where could I find the policy?

    I have got two offers. Both the employers are willing to help me apply for H1B, but I need to pay all the fees by myself. I think that is ok for me. But under this new policy, I am not sure whether this strategy would work out or not. I really very worry about this issue. Your kindly help is highly appreciated!! Million thanks!

    If you are impacted by unavailability of visa number, you can get 3 year extension of H1B after I-140 is approved. If your priority date is current, then you have to file for status adjustment, not H1B extension. If your lawyer does not understand the law, better get a "real" lawyer :)

    I just got my Labor approved a couple week ago and now i want to file I-140 premium processing. But my lawyer's not allow me to do that coz once my I-140 approve i can't file my 8 th year extension. My 7th years H1B will expire on Aug 30, 2007.

    I'm very confused now, on my understanding once i get my I-140 approve, i'm eligible to get my H1B 3 years extension.

    FYI: i chose CP opotion, is that make me not eligible to get my H1B extension once my I-140 approve?

    I was with couple of Big 5 consulting firms. Its good to work for them to add some weight to your resume. But I feel they really dont care for employees let it be immigration, comfort feeling, value to the employees etc.

    So make terms clear before joining.

    I am in MD and 140- is already approved, 485 filed on 12th July at Nebraska, where to file EAD and 131. ?
    If you have the receipt notice of I485, then find out the A# from it. Then apply for EAD and AP online( you need to fill A# at one place in both EAD and AP forms online). They can be applied together(online) but I don't know about applying by mail as I always applied for EAD and AP online.
