Hello everybody,
I just got an RFE for I-485...they are asking about marriage certificate and birth certificate...when I applied for I-485, I sent marriage certificate and birth certificate ..why they are asking me again to send?
And can you tell me please what to do with the following.......Uscis sent me too an envelope where to put my documents for RFE.......but the docs dont fit in the small envelope...is it ok if I put my docs in a different and bigger envelope?
My PD is sept 2005 ROW.
If someone faced the same situation please help me with some advice.

USCIS Revises Filing Instructions and Direct Mail Program for the Application to Replace Permanent Resident Card (Form I-90)
WASHINGTON � U.S. Citizenship and Immigrations Services (USCIS) published a Federal Register notice on April 28, 2009 that changed the filing location and filing instructions for the Application to Replace Permanent Resident Card (Form I-90). The revised filing instructions require applicants to submit supporting documentation with their applications. Prior to this change, applicants were instructed to bring their supporting documentation to their biometrics appointments. The notice also revises the Direct Mail address for the Form I-90. Applicants must now file their Form I-90 and supporting documentation with the USCIS Lockbox facility in Phoenix.
This change in filing location affects all I-90 applicants filing a paper form, including those applicants filing the I-90 because their previously issued card was never received or because their existing card has incorrect data due to a USCIS error. This notice does not affect applicants filing an I-90 electronically or whose place of residence is outside the United States.
Beginning on April 28, 2009, applicants must submit their Form I-90 and supporting documentation to the USCIS Lockbox facility in Phoenix for initial processing, using the following addresses:

I want to find out if the remarks section of the I-693 form should be filled in by the civil surgeon for applicant who has LTBI and according to CDC is recommended to go for Evaluation for Treatment for TB.

Only complete Part 3, Referral to Health Department or Other Doctor / Facility, if the referral was required, such as when a Class A condition is suspected and needs further evaluation. Do not complete Part 3 if the referral was merely recommended by the CDC. Instead notate the (recommended but not required) referral in the Remarks box under that particular disease or disorder. This will help alleviate the possibility of USCIS rejecting the Form I-693 due to an erroneous assumption that a follow-up evaluation was needed before completion of the form
I know the Part 3 should NOT be filled by the civil surgeon if the applicant has Class B latent TB. (PPD positive) AND X Rays clear of any Active TB.
If the remarks section is NOT filled in, would there be any problems? Civil surgeon has marked Part 2 with Skin test positive and the size of the induration. Also, he has marked the X Rays normal but he has NOT filled in the Remarks section. I hope that is OK.

Hi.
I am planning to invoke AC21 via H1B.
My old employer have no issues continuing the same attorney for my future needs.
My new employer asked me to go with their attorney... but I am planning to go with my old guy who applied my 485.
Can I pay AC21, future expenses etc charges from my pocket since I am going with my old attorney.
Is it OK to me paying fees for the GC instead of Employer? Or I shud go with New company Attorney?
Appreciate your help on this.

was your 140 approved at TSC? i read somewhere that 485 goes to the same place where 140 was approved. you may want to ask your attorney why they sent to TSC

There is a quirk in the SSA software! I applied for SSN for my two sons on August 31, 2007. Two weeks later I got the card in the mail for one son. After waiting another three weeks I went back to the SSA office and found that the application for the second son had been deleted! I was asked to resubmit the application which I did. After two weeks the card arrived in the mail but guess what? The card had my second son's names but the SSN already assigned to the first son.
Another trip to the SSA office revealed that their system would assume it's the same person if the first three letters of the first name and the first three letter of the last name as well as address match! Who would design such a matching algorithm? Why did they not match on birth date as well?
Anyway, I went back to the SSA office today and a new number is yet to be assigned to my second son! I was told the application is now with their headquarters where someone will manually assign the number.

Short answer: No.
However, that said, you could have multiple H1 visas and work full-time for one and part-time for the other, as long as the first one doesn't have a problem with it :-)
If you get paid for work in the home country, there may be complications. One being that you'll still be taxed in the US. Consult a good Immigration attorney and a good CPA before doing anything like this.

In G-325, there is one column for "Applicant's residence last five years".
For me, I have not submitted my current address by filing AR-11 form. This G-325 is asking my present address plus last addresses. So what should I do? Do I need to send them AR-11 form too?

IRS is very clear on this. SSN+ITIN couple filing jointly, no rebate for either of them. See this link http://www.irs.gov/newsroom/article/0,,id=179211,00.html
However, you should apply for an SSN for your wife ASAP. You may retroactively get this 2007 rebate when you file 2008 taxes.
Using your wife's SSN for tax purposes will not impact her legal status in any way.
Is it true that H4 spouse, who do not have SSN are not eligible for tax rebate if while filing a joint tax return for 2007 ITIN is used for spouse.
It seems ITIN is given to illegal aliens too and hence it is not possible for IRS to determine which ITIN holders are legal and which are illegal. Thus they are not going to give tax rebates to ITIN holders.
My wife is on H4 and has a EAD/AP. Should I apply for SSN to receive the tax rebates? But since the tax rebates are based on 2007 tax return I will have to file the tax return using her SSN to get the rebates.
Also will SSN affect her H4 status if EAD is not used?

Since I got electronic refund to my tax rebate and have SSN for all family members, I was expecting Tax refund (stimulus) to be deposited in my bank accoung this week. This was big announcement in the last week.
But I dont see any rebate deposited in my account?
Does any of you have received such rebates?
Is there any contacts numbers where we can approach if we did not received Stimulus rebate al though we filed electronically?

I did received the money on May 2 nd. The date when you receive your money depends on teh last two didigit of your SSN number. PLease check IRS.Gov there is a link to check your sttaus.

My MTR was received by USCIS on June 25, 2009. Today I received an auto-generated email with case status update. My MTR has been denied :-(
