You should have no problem filing a 2nd 485 even though you already have one pending. This happens often, especially when a foreign national marries a US citizen while an employment-based 485 is pending. I've prepared this type of case many times. the faster 485 will be approved (hopefully), so the slower one will be denied because you already have permanent residence at that point.

In recent months, Dobbs has run countless upbeat reports on the "citizen border patrols" that have sprung up around the country since last April's Minuteman Project, a paramilitary effort to seal the Arizona border.
But there's one thing Lou Dobbs won't do. No matter what others report about the movement, Dobbs has failed to present mounting and persistent evidence of anti-Hispanic racism in anti-immigration groups and citizen border patrols.
It's not that Dobbs hasn't allowed a pro-immigration activist or two to complain about efforts like the Minuteman Project ("vigilantes," according to President Bush), or even that he has made racist statements on his show. What the anchorman has done is repeatedly decline to present the evidence that links these groups to racism, calling the very idea "mind-boggling." On his July 29 show, he called the ACLU and the Southern Poverty Law Center, which he said he liked in other ways, "despicable" and "reprehensible" for saying otherwise.
Consider some of what Dobbs has failed to report, despite the fact that in almost every case these developments were reported widely elsewhere:
GLENN SPENCER, head of the anti-immigration American Patrol, has been interviewed at least twice on the show, on Jan. 7 and June 4, 2004. Spencer's Web site is jammed with anti-Mexican vitriol and he pushes the idea that the Mexican government is involved in a secret plot to take over the Southwest -- facts never mentioned on Dobbs' show. Spencer's group is regarded as a hate group by both the Southern Poverty Law Center and the Anti-Defamation League. Spencer has spoken at least twice to the white supremacist Council of Conservative Citizens, which has described blacks as "a retrograde species of humanity," and once to American Renaissance, a group that contends that blacks are genetically inferior to whites. Dobbs has never reported those ties, or mentioned Spencer's more wild-eyed contentions, such as his prediction that "thousands will die" in a supposedly forthcoming Mexican invasion. Although Dobbs has steered clear of the racist comments that some of his guests have made elsewhere, he has warned of "illegal aliens who not only threaten our economy and security, but also our health and well-being," according to Fairness & Accuracy in Reporting (FAIR), a media monitor. In 2003, FAIR added, a reporter on Dobbs' show grossly mischaracterized a National Academy of Sciences report. The report found that immigrants provided a net gain of $1 billion to $10 billion to the U.S. gross domestic product, but the CNN reporter said the report had found the economic impact of immigrants worked out to a net loss of up to $10 billion.
Dobbs is revered in anti-immigration quarters and on the far right generally. He is the winner of the 2004 Eugene Katz Award for Excellence in the Coverage of Immigration, given by the Center for Immigration Studies (CIS). CIS claims to be a "nonpartisan research institute," but in fact is a thinly disguised anti-immigration organization. The 2005 Katz Award went to the immigration beat reporter for The Washington Times, a hard-right newspaper based in Washington, D.C.

Don't be. You will be current in Oct and I believe going forward (chances of retrogressing to 2005 is very slim if at all there is any retrogression).
That said, don't wait for USCIS. Be proactive and do all you can. I would suggest
1. Calling the USCIS customer service (get hold of level 2 rep by telling the level 1 your case is outside normal processing time) and try to get the status of your case. Might take few tries before you can get some info.
2. Open an SR.
3. Do the above for your dependents if any.
4. Make infopass (you have already done this).
5. Contact local congress man/woman.
6. Send mail to CIS Ombudsman
7. If your security check is not cleared yet, you can contact FBI (by phone) and find out the status.
(more information on all these can be gotten from simple google search. If not, post here and some one here should be able to help you.)

Good; So this is what I understand:
You are working for employer A. Before the expiry of I 94, you applied for extension with employer A and that extension is still pending.
After the expiry of I 94 (and pending extension) you applied for employer B, that did get approved but came without attached I 94.
You are still working for employer A and that extension with employer A is still pending.
If above facts are correct, you may be fine; however question is, why is your extension with employer A still pending; and what can you do about that. Depending on specifics of your case it may be time to make it premium or simply leave the country and return back on employer B's H1B and work for that employer.
You still need to talk to a good attorney to see which one of the above options are good for you.

Yahoooooooooooooo......We (Me and my wife) received welcome notice today . Our 485 is approved on 25 th March.
no updates online just received postal mail from USCIS today .
I guess end of long wait , been in country from 2001 .
I wish you all the best and hang in there if your PD is current you can expect the notice any time so keep checking your postal mail box .

Guys,
I want to know what are the chances of getting I-140 approve if we file a new petition and current I-140 appeal process is pending with USCIS. My I-140 was denied on education basis. In denial notice USCIS wrote that we did not prove that my 3+3 (Diploma + Engg degree from India) degree is not equivalent to B.S in Computer science from Labor certification.
Guys please share your experience with me since its important for me to get I-140 approve for future growth.

Per Lawyers response both AOS and CP are possible. When I mentioned 180 days the lawyer mentioned it is 2 yrs not 180 days for follow to join.

You can avoid the waiting period by using "Notice and Consider".
I had the same experience with FDBL lawyers, those guys were awful.
Luckily BAL took over, and they mentioned about "Notice and Consider" and did make use of that for labor filing.

Let's assume Two people A and B entered into US on Jan 1st 2004 with Visa stamping Valid till June 2006.
A is without payslips for 2 years , that is until Dec 2005(730 days).A travels out side US and re enters into US in jan 2006 , after that he'll get the payslips and stays legal , then applies for his 485 in March 2006.Then he is maintaining
100% legal status as he is having continious payslips after his re entry.
B doesn't have payslips for period of 185 days(aggregate) in his whole stay in US , rest of the time he maintains legal status , but he never travels outside US and applies for his 485 in March 2006.
In this case B is under risk of illegal status for more than 180 days , as he never travelled outside US.How come this is fair law??This thought bugging me since coupe of days.Guys please share your ideas.

Can someone go fr 2 jobs after EAD approval( i will use my EAD). Is is required that the job description of these jobs has to be same as filed in the application ? appreciate your help
I think you need seperate EADs for each jobs. 2 jobs means 2 EADs..:confused:
Common, You can do any number of jobs with ONE EAD. If you don't invoke AC 21, then why are you worrying about Job Description???

why is name check still an issue? I thought the Feb memo spelt it out in no uncertain terms.

Ok, I'm really confused. These photos were taken back-to-back.
And if you notice one has the dirt or whatever it is on it and the other doesn't.
I cleaned the sensor and I always clean my lenses.
So I don't understand what the deal is, sometimes it has it sometimes it don't.
Any ideas?
