Hi,
Myself and my wife filed our I-485 applications a couple of years ago. My wife was supposed to fill the date of birth of her mother in the application form. My month-in-law was born in a village about sixty five years ago, and nobody is aware of her precise date of birth. So we filled a date that was the most probable date as per our best judgment.
We forgot about the matter till now. However recently my folks back in India got a passport made for my mother-in-law. In the passport they filled a different date of birth (same year, different day and month). I came to know of this issue when we were planning to obtain a visitor visa for my mother-in-law.
How will this issue impact our pending I-485 applications, and the chances of my mother-in-law obtaining a US visa. It was a genuine mistake with no ulterior motives whatsoever. However now the lady has two different DOB in two different set of documents (her passport and her daughter's I-485 application). Should we take any steps to rectify the matter, or just ignore it.

Hi All,
Here is my question.
I was working for employer A.I left employer A on Nov 15 , I received my last paycheck from employer on Nov 22, 2007.
I know my employer A did not revoke / cancel my H1b.
I accepted offer from employer B on Nov 20.I came in communication with employer B lawyers on Nov 23.I am based in one state and work

send the request for them.We received prevailing wages from states on Dec 11.Then she sent my H1b transfer petetion to USCIS on Dec 14.I received

My husband has a pending I-130 visa petition (I am a US citizen, he's Italian, we live in Italy). Can anyone tell me whether he is permitted to enter (and exit, as we are still residents in Italy) the US on holiday (departure 19 dec)?
I have not found any specific details in regard.

No... as long as you can show ties to the US (owning a house, paid taxes, etc) you should be OK. In a situation where a company has sent you overseas, if you have adequate documentation to prove that the company had sent you overseas and you are still on the payroll here, you should be OK. Although, to be safe, I would probably try to make a couple of trips back to the US in a year to maintain resident status.

We are working on a document that details what gives advice on what we did and how we did it. As well as things we learned that we should have done!

I was laid off from company A in MAY 2002 (got salary till 31st May), later joined company B from 1st July 2002, so, I think, I was �out of status� for 1 month, later left company B because of differences on 31st October 2002 (received salary till 31st Oct ) and filed for H1 transfer with other company C on 11th November 2002, I got H1 approval on March 10th 2003, and started working with company C from April 2003 till now, so have 5 months gap between company B and C.
Was I out of status? If yes, looks like I was out out status for 6 months (5months continues plus 1 month earlier), unfortunately this comes to 181 days (june, nov,dec,jan,feb,march).
My I-94 was never expired and I went to India in Feb 2007 and got H1B stamping done and entered US with no problem.
I started my labor with current employer in May 2004 and got I40 approved as well, now filed for 485 in july rush, got EAD and fingerprinting notice, I am worried that my 485 may be denied because of �out of status� in past.
My Question:
1.Was I technically out of status and unlawfully present?
2.How does 180 days calculated? (continues 180 days or 180 days added in two time span like mine)?
3.If there was any out of status or unlawful present in past, Is it erased after lawful entry in US (I did enter in US this year after H1 stamping in India)?
4.Is Fingerprinting notice assures that everything is fine except security and criminal check?
Please help? I am really tensed after reading few forum, This will be horrible emotional set back for me and my family after 6 years in waiting if our 485 is rejected.

Hi everyone,
I'm thinking of going into graduate school next year under F-1 status, which presumably should last until the end of my program in 5-8 years. As many of us are painfully aware, students aren't allowed to work except on-campus or as part of approved OPT and CPT programs.
My question is: is it possible for me to take out a TN (NAFTA) visa during the summer of one of my years so that I can work? F-1 and TN are both non-dual intent, so is it possible?

You need to have PT license to work. Every state has different rules, there is lot of paper work involved to sit for license exam. For Indians, mostly it was easy for Michigan, New york. For present scenario better check physicaltherapyforum.com, very good info avaliable

You can do Info pass and ask for both. Alternatively, you can try calling USCIS when your priority date is current and ask for this information. If you are lucky, they will tell you whether or not there are any security checks are pending. People noted that there are no LUD when NC gets through. On the other hand, if one has a FP and a couple of days later there is a LUD on I485, that often means FP cleared. Remember that FP and NC are completely separate tasks.

It seems to me, you are on a B1/B2 and are contemplating a marriage to a "485 current" green card benfeciary...and subsequently filing the 485 jointly with your would be other half...
The intention in a B class visa is very weak and its purpose very limited. It is best to not do anything while on the B visa, and relinquish the B status, then either re-enter on a stronger intent visa (H1/H4 or L1) and then file 485 or file the 485 from outside the country.
Any change of status from a B class visa is usually looked upon with a frown by the USCIS...
Even if you are not contemplating a marriage, but are already married for long but just happen to be in the US on a B Class visa, it is best to reliquish your B status, before doing anyting...

I am really confused about my current status.
I am currently on Opt Extension, which expires on June 1st 2010.
When i filed for H1b visa last year April 2009.
I got my petition approved, but my change of status was denied.
The reason was stated as :

I am not aware of any required time while in adjustment of status. There is on GC but not in AOS pending

There is nothing like losing. If it expires, you will have to renew it.
