Great story, another example how the illegal immigration debate is now a big part of our culture.
In 1993, when I was 14, I became a regular on �Sesame Street.� The show usually liked to have a teenager on, so that was me. My character had my same name, Carlo, and eventually I got a job at Mr. Hooper�s store. I had to make a birdseed milkshake for Big Bird, that was my tryout. I ended up appearing on �Sesame Street� for five years. But the whole time, I had a secret: I was an undocumented immigrant. The papers I�d used to get hired were fake.My family had come from Ecuador when I was seven and my older brother Angelo was nine. We came on a tourist visa, and the moment my parents had gotten it, we knew we were not coming back. They sold all our furniture before we left.
My mother had a sister living legally in the United States, and my parents planned to have her sponsor us for residency. Soon after landing in New York, my parents saw a lawyer. But we were told the process would take four or five years.
Coming to the States was traumatic. In Ecuador, we had lived in a house. Here, we were in a small apartment. We didn�t know any English. But you know, at that age, things change quickly. In six months we were speaking English and running around like normal kids. Most of the time, we blended in. But we knew weren�t supposed to be here, and we lived with a lot of fear.
I started acting when I was 11, almost as a fluke. One day, we went to visit our cousins, and they were on their way to try-outs for a community theater production of �Oliver!� It was through a program put on by the city, to get disadvantaged kids off the street. When we got there, the producers were like, �You should try out, too.� So my brother and I did. Then we all went to lunch. When we got home, we had a phone message that we�d both been cast. I was Oliver.

I am currently awaiting approval for my I-485. My priority date is August 2006 and I completed fingerprinting on Oct. 29th.
I understand the process of allocating green cards based on employment-based category and queuing based on the labor/priority date.
My question is regarding COUNTRY LIMITS. What role do these limits play in the approval process? To be more specific, if the applicant is from a country that has a very low number of GC requests, does the fulfillment of the country limit take precedence over the priority date/EB category or does it succeed the latter?

Not really. If you see the late June submitters thread, many of us who applied in the June 20th timeframe have got their receipts. It took us 5 weeks to get the receipts from the date of filing.

In my employer company (NJ based, desi consulting company) about 50% of the EB-2 PERM applications are under audit.
I need to file my application for EB-2 and I called them. (I have a EB-3 approved labor, on which my employer has filed I-140)
The paralegal advised me that they have stopped filing PERM applications since this month March 2008, hoping that there would be change of PERM processing or application change.
Does any one have any info about PERM change process? Please advise. Thanks in advance.
The DOL was supposed to issue new forms, since the current ones were said to expire in 3/2008. However, they have not issued new forms yet, and on their website it states that the current ones continue to be valid. Their site was down for maintenance around the end of March, however, so perhaps that's what the paralegal was referring to?

I don't see any issues for your wife to convert to F1 now and then apply for I-485 when your PD gets current. However once she applies for I-485 then it will be risky to apply for extension of F1 or stamping F1 as F1 does not allow for dual intent and she would have shown her intent to immigrate. So after applying for I-485, it will be advisable to switch to EAD / AP for work and travel.

My wife wants to convert from H4 to F1 for coming Spring 2011 so that she can take assistantship..
Is it advisable to change status to F1 with priority date so close..? does it cause any problems for her I485 application since F1 status is Non-immigrant category..

I just went to Mumbai for H1 stamping and my previous visa on the passport had expired in 2006. So even if you are going for H1 stamping but your visa on the passport has been expired for more than 12 months...then you have to answer NO for this question.

My dad wants to visit the U.S. Who would be better to sponsor him ?

Sorry I am not going to be help, but I would be interested in knowing when you find, why that was so.. I am one of the unlucky few whu missed the July 2007 filing bonanza by 1 day, based on when my labor was filed.. so if there is an alternate way to assign PD.. I can still continue crying....:confused:

Hi all!
I've been trying to get a job offer from Canada for the past one year as my occupation is not on the list of occupations that have shortage. I'm a market research analyst and work online with a UK company for almost 3 years. I would love to move to Canada and have a real job and family but am at a stage where I do not know what else to do as the companies want you to be present in Canada and Canadian govt asks for a job offer to get a visa?
Very confused here. If someone got an arranged offer from Canada could you please guide on how much work experience you had and how you got an offer?

If wife name is not mentioned what is the consequence?
I just checked mine, my wife name was mentioned but my son wasnt, and we applied his 485 without any problems, so i think you should not have any problems as long as you file her 485 with marriage certificate before your 485 is approved.

Yes , I did extension for H4 to avoid out of status. But that will automatically override her approved H1 to h4.(The latest one is valid). But when ever she is ready to work, (in her case she is pregnant and planning to work from next year only) her employer has to change the H4 to h1b(COS). There is premium processing and it would take only 15 days. No need to apply for a fresh H1b.

I entered US on H1 and the officer stamped the I-94 expiry date to the expiry date of the passport. I applied for a new passport but forgot about the I-94 expiry date. Does it mean that my H1B is expired and not valid? Can I re-enter US on the same H1B visa. Or, my H1B is no longer valid and I have to use AP?

I am leaving company A to join Company B. My first 3 year term of H1 is expiring with company A soon in the next 6 months.
1. Do I have to apply just H-1 transfer or (H-1 Transfer + H1 extension) with company B?
2. Is there any number of weeks or period that I can be with out any pay stubs from company A after I leave them before I join company B? Will I fall 'out of status' as soon as the company A stops running pay stubs (they may not revoke immediately as my 3 yr H-1 is expiring with them soon anyway)? I am asking this because the company B may take a couple of weeks to employ me and start paying me.
3. Company B is doing good now. But who knows what will happen in this recession economy?! What are my options to be in legal status if I get laid-off by company B after H-1 transfer with them OR if the H-1 transfer to company B gets rejected for whatever reason?
