    Hi folks

We have applied for COS for my wife from H4 - F1, and yesterday we got approval.
    (TOOK ONE MONTH APPROX),
    Now the question is,
I AM AWARE THAT SHE HAS TO GET STAMPED IF SHE TRAVELS TO INDIA, BUT what if she travels to India, when on OPT status????

Any seniors had experienced the same situation?????????

    Pl advice

    JAGGU BHAI

u can come back on OPT only if you have a valid and current job offer. On F1, u have to come back on stamping.

---I'm only talking in regards to FY-2007 in light of current development.---

Now that everything is current there would not be any need to per country quota. CORRECT?
Or since EB3 other is not current ("U") they cannot use AC21?

they have hinted retrogression in Sept for China, India, etc

Now if there is no per country quota, how can they retrogress EB for China, India, or any other country unless EB3 ROW is not current?

So unless they retrogress ROW, logically they should not retrogress at least EB2 for India, China and other countries

correct. Which means, come September EB3-ROW is also going to get retrogressed. probably to where it is now.

i think at re-entry for the 485 pending /AP applicants, there is a POSSIBILITY that the officers could question you bout ur existing employment. For such cases people r adviced to carry the current employers letter along with copy of 485 receipt for safety sake.

with that in mind, if all possible, using ur EAD(after that 180 day rule) , get a job may be collect a paystub or 2 , get a letter and then use the AP.

in many other forums, pple have shared info such as "officer asked me if im still employed with the same employer who filed for GC." etc etc . its better to carry something atleast to prove that when asked.

An investigative report by National Public Radio today sheds light on the behind-the-scenes effort to help draft and pass Arizonas immigration law SB1070 by the private prison industry. Private prison corporations like the Corrections Corporation of America, the Geo Group and Management and Training Corporation have funneled tens of thousands of dollars to the 30 legislative co-sponsors of SB 1070.

Think Progress also highlighted reports that the billion-dollar Corrections Corporation of America the largest private prison company in the country has directed money to legislators sponsoring Arizona-like immigration bills across the country. Following is a statement by Ali Noorani, Executive Director of the National Immigration Forum, a non-partisan, non-profit, pro-immigrant advocacy organization in Washington.

Todays revelations show that immigrant detention in America is not driven by justice but by the private prison industry looking to make a buck off the imprisonment of nannies and landscapers. Taxpayer money is being used to expand and establish a steady source of income for the prison industrial complex which is clearly benefiting from a broken immigration system that feeds immigrants into the detention system.

The true motives behind the controversial Arizonas immigration law were not about increasing security or addressing Arizonas immigration problems, the goal was to enhance the prison industrys bottom line.

We cannot simply detain and deport our way out of our immigration problem. This report should sound the alarm bells over the urgent need to restore order, integrity and accountability to our immigration system.

Immigration Visa Attorney Blog Has Just Posted the Following:
http://www.immigrationvisaattorneyblog.com/Pinocchio.jpgBorder guards are not known to be the friendliest people in Federal service. The immigration attorneys at Fong & Chun in Los Angeles routinely hear stories of border guards shouting at aliens who are telling the truth, bluntly telling aliens, "you are lying to me," or asking in a hostile manner, "why are you lying to me?" The border guards do this, even when they do not really think someone is lying. They do it to destabilize or disturb the alien, to get the alien to make an error or say something wrong. Basically, it is a trap.

Recently, Alan Bersin (http://en.wikipedia.org/wiki/Alan_Bersin), the commissioner of US Customs and Border Protection (http://www.cbp.gov/) -- the head of all the border guards -- told Congress (http://www.google.com/hostednews/ap/article/ALeqM5j07I9Bw4Q1kxusXReW4qAjNPdR2AD9FM4S300) that he did not know he was required to fill out and keep Federal paperwork to verify that his household employees had the right to work in the USA.

Bersin is the head of US Customs and Border Protection.

Bersin is a former California Secretary of Education.

Bersin is a former US Attorney.

Bersin went to Harvard and Yale.

Bersin says he had no idea he had to follow the law?

Why is he lying to us?

H-1B visas are work visas that allow foreign nationals to temporarily work in the United States for a U.S. employer. A U.S. employer may petition a foreign national under the H-1B classification which specifically applies to individuals in a “specialty occupation." A specialty occupation has three requirements. First, an individual must have a bachelor’s degree or higher degree or its equivalent for the particular position. Second, the degree must be common in the industry among similar organizations. Third, the employer must normally require a degree or equivalent; or the nature of the specific duties is so specialized and complex that knowledge required to perform the duties is usually associated with attainment of the degree.

Individuals with H-1B visas are allowed to work in the United States for up to six years, but visas are granted in three-year increments. In some cases, the H-1B visas may be extended for more than six years. If the individual is in the United States, a change of status to an H-1B is filed in the United States. If the individual is outside the United States, upon approval of the petition, the individual must apply for an H-1B visa at the U.S. consulate. There are only 65,000 H-1B visas issued per year.

The beginning of the fiscal year for 2010 is October 1, 2009. Employers may begin filing their petitions six months prior to the start date of employment but the individuals cannot start their jobs until October 1.

It is vital for those individuals wishing to work in the United States to begin preparing their H-1B paperwork before the cap is reached. As of August 7, 2009, approximately 44,900 H-1B cap-subject petitions had been received by U.S. Citizenship and Immigration Services (USCIS) and counted towards the cap. Please call us at 214-999-9999 if you would like to begin the H-1B process. The H-1B cap-subject count is available at the USCIS Web site (http://www.uscis.gov).

The Immigration and Nationality Act (Act) provides for the admission of different classes of nonimmigrants who are foreign nationals seeking temporary admission to the United States. The purpose of the nonimmigrants intended stay in the United States determines his or her proper nonimmigrant classification. Some classifications permit the nonimmigrants spouse and qualifying children to accompany the nonimmigrant to the United States or to join the nonimmigrant here. To qualify, a child must be unmarried and under the age of 21.

F-1 nonimmigrants, as defined in section 101(a)(15)(F) of the Act, are foreign students coming to the United States to pursue a full course of academic study in SEVP-approved schools. An F-2 nonimmigrant is a foreign national who is the spouse or qualifying child of an F-1 student.

M-1 nonimmigrants, as defined in section 101(a)(15)(M) of the Act, are foreign nationals pursuing a full course of study at an SEVP-approved vocational or other recognized nonacademic institution (other than in language training programs) in the United States. An M-2 nonimmigrant is a foreign national who is the spouse or qualifying child of an M-1 student.

SEVP is the DHS program that administers SEVIS. It ensures that government agencies have essential data related to nonimmigrant students and exchange visitors to preserve national security. SEVP provides approval and oversight to schools authorized to enroll F and M nonimmigrant students and gives guidance to both schools and students about the requirements for maintenance of their status.

ICE SEVP I-17 FAQs provide information for schools about SEVP certification, including background on SEVP and SEVIS, SEVP certification basics, an overview of the SEVP certification process, preparing the petition for SEVP certification, and preparing for a site visit.

I couldnt find the form on the uscis website, which generally lists supplemental forms next to the main ones. Couldnt even find a link to this, so wasnt sure if my doc was doing the right thing or following some old procedure.

One more question : I-693 has 4 copies (one for uscis, one for self, one for doc etc). Does it matter which copy goes to uscis (since they are basically the same, except for the text in the bottom which denotes the copy).
Because I think my doc put his copy in the sealed envelope, and gave me a photocopy of that.
Should I go back and have him redo the form (he has bad handwriting too, like most doctors)?

I'm a US Green Card. I am eligible to apply for my citizenship but have run into a technical issue. I registered to vote in August 1999, but never voted. It was my 2nd semester at a community college in Chicago and the professor was encouraging everyone to register to vote. Taking his advice I too registered to vote not knowing that I was ineligible. I did sign the form which states "I hear by swear (or affirm) that I am a citizen of the United States..." Unfortunately I did not read the fine print before signing the application. As it was not my intension to vote, and I merely did it on the request of the professor, I did not vote.
In 2005 I switched from a F1 to a H1 and in 2006 married a US citizen with whom I have 2 little kids. I am now eligible to apply for my citizenship, and would like your professional opinion on how I should deal with this situation.
To ensure my voter registration application was in fact processed I did request the Chicago Board of Elections for a copy of the application. I am also in the process of requesting them to de register or cancel my voter registration and provide me with a letter stating my voter registration has been cancelled and that I have never voted.
I would really appreciate your help.

I lost my job about a month ago with fortune company where I had my H1 and then I filed to transfer my H1 to the GC filing company. It got approved last week. They even seem to have sent the I 94 with the H1 approval.

I have a visa from the earlier company(fortune company) till dec 2009 in my passport. Do I now need to get a fresh visa again with the new (GC) company that has sponsored my H1. Or is the visa validity in my passport is good enough to work even for the new employer?

Your old visa stamp is good.

With the D100 now carrying a street price of $1499 from legitimate dealers...things are looking mighty nice as the price of admission for quality gear keeps going down.
There are regular refurb D100 for $1,199 on the market recently.

If you want the best value for money, the E+ rated, at Adorama now, 35-70/2.8 AF-D and 80-200/2.8 AF-D are the best buy in town. I always tempted to get them to add a few zooms to my primes.

But until the 1Dx comes out which is 4mp, and the 1Ds holds a price above $6,000 until April, I am NOT buying any more Nikkors, unless the FF digital F6 announces on time, which I think is an impossibility!

    Technically ...... "ZERO" (no time-gap).
But don't worry about it too much (what can you do). Get your next job ASAP, and file for "premium processing".

In the past "extension of status" petitions had got approved even after almost a month gap, with good explanation. But you can never count on that.

Worst thing that can happen for a valid new H1 job is USCIS approve your H1 but reject your "extension of status" (I797 without I-94 attached). In that case, you might need to travel outside of USA and get your visa.

Either way, don't go beyond 180 days. There will be additional consequences.

Hello, I lost my job today, but I have H1B. So what's the time gap for finding a new job?

    Thank you very much.
